WEBSITE CARE MAX PLAN TERMS OF SERVICE AGREEMENT

1. Overview

This Terms of Service Agreement (“Agreement”) governs the provision of the Care Plan Max package (“Service”) for your WordPress website. By subscribing to this Service, you agree to comply with the terms outlined below.

2. Scope of Services

The Care Plan Max includes:

  • Daily Backups: Your website will be backed up daily to ensure data security.

  • Site Migration and Cloning: Provided as required for complex updates.

  • Safe Managed Updates: Updates to WordPress, themes, and plugins will be managed securely.

  • Quarterly Website Upgrade: A comprehensive website upgrade will be conducted every quarter.

  • Plugin Renewals Management: Assistance in monitoring and renewing necessary plugins.

  • SEO and Website Traffic Monitoring: Monitoring to optimise website performance.

  • 24/7 Malware and Vulnerability Scanning: Continuous security monitoring.

  • Monthly Reports: Summary reports outlining website performance and updates.

  • Human Monthly Check: A manual review of form and site functionality.

3. Small Changes

Subscribers receive unlimited small changes per month. A small change is defined as a task requiring less than 30 minutes, such as updating text or images. This does not include:

  • Fixing broken functionality requiring extensive problem-solving

  • Creating new pages

  • Significant page restructuring

4. Monthly Development Retainer and Website Management Support

The Service includes 5–7 hours of ad hoc support per month, which can include:

  • Implementing new functionality

  • Resolving functionality issues

  • Page restructuring

  • Landing page development

  • Support for member issues, course or store management, and advanced problem-solving

Any additional development time beyond this limit will be quoted and charged at an ad hoc rate of $200 per hour.

5. Malware Infections

  • One full-site malware cleanup per year is included in the plan if an infection occurs that cannot be removed via a site roll-back.

  • Any additional malware cleanups beyond this annual inclusion will be charged at $300 + GST.

  • If the website is not hosted with Wise Up Marketing, malware infections are not covered under this plan and will be cleaned at $300 + GST per occurrence.

6. Response Time and Urgent Requests

  • Standard response time is 24–48 hours for all requests.

  • Urgent requests requiring more than one (1) hour of support may be subject to an additional fee.

7. Cancellation Policy

  • The Service may be cancelled at any time with 30 days’ written notice.

8. Payment Terms

  • The monthly fee is $950 per month + GST, due in advance of service provision.

  • Additional work exceeding the included retainer will be billed separately at the agreed rate.

9. Liability and Limitations

  • While we take all reasonable precautions, we are not responsible for any direct, indirect, incidental, or consequential damages that may arise from the use of this Service.

  • The Client is responsible for ensuring compliance with applicable laws and regulations related to website content and data protection.

10. Amendments

  • This Agreement may be updated from time to time, and continued use of the Service constitutes acceptance of any changes.

By subscribing to this Service, you acknowledge that you have read, understood, and agreed to the terms of this Agreement.
